It is no surprise that as spam has become a large problem for many individuals and businesses, with a huge cost to many that the United States of America have introduced the CAN-SPAM Act, which is “Controlling the Assault of Non-Solicited Pornography and Marketing.” This Act was introduced in 2004, to give guidelines for the senders and content of emails being issued, set out penalties for spammers and give a recipient the right to ask the senders of emails to stop spamming them.
The law was introduced to cover the promotion and advertising of products, websites and services. The law doesn’t cover emails that are being sent with the recipient’s prior consent, or where a business relationship is in existence, such as updates to a previous customer of a business. If emails that are sent – even with prior permission – contain false or misleading information, the Act will apply.
There are many rules to follow in the sending of emails, and it is important that they are followed to avoid being in violation of the law. All emails must contain the postal address of the sender, with a clear opt out method. The subject line of emails cannot be misleading, or include false information to entice you to open the email, which is a common ploy by spammers.
There are many requirements for legitimate emails, although the existence of spam and junk emails will still be a problem for many.
